Consular legalization of documents for investment in Vietnam

Foreign organizations and individuals investing directly in Vietnam must comply with the laws on investment. Documents proving the legality and existence of the investor are indispensable when carrying out the procedures for registering for an Investment Registration Certificate (IRC). However, these papers and documents need to be consular legalization for recognition and use in Vietnam.

1. What is consular legalization?

Vietnamese law stipulates that consular legalization is the “certification by the Vietnamese competent authorities of seals, signatures and titles on foreign papers and documents so that papers and documents are publicized, received and used in Vietnam”.

Consular legalization only certifies seals, signatures, titles on documents. This activity does not imply certification of content and form of papers and documents. Note that even though the content is not certified, the papers and documents with contents violating the interests of the Vietnamese state or not in compliance with the guidelines and policies of the Vietnamese state will not consular legalized.

2. Competence to carry out consular legalization

Consular legalization authority includes the following agencies:

– Consular Department (Ministry of Foreign Affairs), address: 40 Tran Phu, Dien Ban, Ba Dinh, Hanoi City;

– Ho Chi Minh City Department of Foreign Affairs. Address: 6 Alexandre de Rhodes, Ben Nghe, District 1, Ho Chi Minh City;

– Departments/Divisions/External Relations of provinces/centrally run cities (local foreign affairs agencies) authorized by the Minister of Foreign Affairs. The list of local foreign affairs agencies is listed on the Consular Information Portal;

– Vietnamese representative agencies in foreign countries: embassies and consulates.

Time for receiving and returning results of the above-mentioned agencies is from Monday to Friday and Saturday morning, except holidays.

3. Dossiers requesting consular legalization of papers and documents

Organizations and individuals prepare the following documents:

– 01 consular legalization declaration made according to a form issued by the Vietnamese Government;

– The original copy of the personal document (citizen identity card, passport) of the person submitting the application;

– Originals of papers and documents proposing consular legalization;

– 01 copy of papers and documents requested consular legalization;

– 01 translation of papers and documents requested consular legalization into Vietnamese or English;

– 01 photograph of translation of papers and documents.

4. Procedures for consular legalization

Dossiers are submitted at the reception department of the consular legalization authority. Papers and documents will be consularly legalized within 01 working day from the day on which the competent authority receives a complete and valid file. In case there are 10 or more papers and documents, the time limit for processing may be longer but must not exceed 05 working days. Consular legal fee is 30,000 VND/time/paper. Note that the fee for is collected in Vietnam Dong (VND).
